The description states that the image is a still from a German TV show. As such, the copyright is almost certainly owned by the company that produced the show and not Mark Bellinghaus, as the upload comment claims. But even if Mr. Bellinghaus does own it, one cannot legally assert ownership of copyright and, at the same time, release it into the public domain. Hux (talk) 00:19, 31 August 2008 (UTC)
- Keep. I changed the tag to {{Non-free television screenshot}} --Eastmain (talk) 03:51, 31 August 2008 (UTC)
- Eastmain: I applaud you for attempting to bring the image into conformance with Wikipedia's rules. However, sadly I think the rationale you added is significantly wide of the mark: the image's use contravenes fully half of the points you list in "purpose of use" (points 3, 5, 6, 8, and 10, to be specific). That being the case, I don't think we can use this image. -- Hux (talk) 16:56, 1 September 2008 (UTC)
- Comment Several other images uploaded by the same user and released into the public domain share similar copyright claims, although not all are promotional shots. Delicious carbuncle (talk) 02:51, 1 September 2008 (UTC)
- The images Delicious carbuncle refers to are these: [1] [2] [3] [4]. I think that the same problems apply to those as to this image, i.e. they should probably all be deleted. -- Hux (talk) 16:56, 1 September 2008 (UTC)
- Well, this image is now tagged with a fair use tag, and as such that puts it out of scope for here. Stifle (talk) 11:40, 14 September 2008 (UTC)
- Comment Hope this is not a COI that I'm commenting here, but I'd like to share what I know about these images in question. As Mark Bellinghaus' business partner in MARILYN MONROE PRODUCTIONS LLC, I can vouch that the rights to the images of Mr. Bellinghaus on his Wikipedia article were passed on to Mr. Bellinghaus by the photographers. The photo of the group at the table which includes Mary Jane Popp, June DiMaggio, Robert W. Otto, Hugh Hefner, and Mark Roesler was taken by Mr. Bellinghaus himself at the Queen Mary Exhibit opening and he also owns the rights and has passed these rights on further to MARILYN MONROE PRODUCTIONS, LLC. How can this be properly handled so these images can stay here? Does Mr. Bellinghaus or our company need to grant some type of release? Thank you in advance for your help. --Jenjdickinson (talk) 15:28, 3 October 2008 (UTC)

This image and a number of others were listed at WP:CP on August 31. As images are no longer handled there (though Zorglbot's operator has not been on Wikipedia to modify the creation of an image subpage), I bring them here for attention. Just below, I'm copying the original report. Moonriddengirl (talk) 11:47, 31 August 2008 (UTC)

The source website quite clearly says " Copyright 2000 - 2008 © European Space Agency. All rights reserved.", and the ESA unlike NASA does not generaly release it's material into the public domain, anyything that would qualfy as a free license. Sherool (talk) 16:01, 31 August 2008 (UTC)

The image is easily replacable, non essential and purely for decorational purposes. The image does not add any information to an article besides the photo's themselves, which are freely available in the Public Domain in other images. effeietsanders 18:21, 31 August 2008 (UTC)
- This image is listed on the wrong list, I think since noone is contesting that it is unfree, as all logos are; in fact, its image page states that it is copyrighted by the 2008 McCain presidential campaign. Nonetheless logos are acceptable on Wikipedia to illustrate the organization they designate. This particular logo features likenesses of the two individuals of the named on the campain's ticket, McCain and Palin, much as various logos featuring Paul Newman's image designate "Newman's Own" products and distinguish them from products of competitors'. Justmeherenow ( ) 20:09, 31 August 2008 (UTC)
The logo of a campaign is not replaceable and it is not "purely for decorational purposes." It qualifies as fair use to use it in the Sarah Palin article, just as the Obama/Biden campaign logo qualifies as fair use in the Joe Biden article. Rreagan007 (talk) 21:16, 31 August 2008 (UTC)
- Closed without prejudice - this is not the correct process. You may either use Template:Tls to ask that an admin examine this image or you may nominate it at WP:IFD for broader consideration. (I would suggest the latter as it opens it up to be looked at by more people.) --B (talk) 23:20, 31 August 2008 (UTC)

Aparently tagged as PD-USGOV because the uploader could not find a tag for images from the State of Kentucky, no wonder considering that both the source website and the main Kentucky.gov westite both state: Template:CquoteAn additional complication is that the copyright for something like this most likely belong to the family rater than the state Government. --Sherool (talk) 18:39, 31 August 2008 (UTC)

The result of the discussion was: Wrong forum; please inquire at WP:MCQ-FASTILY (TALK) 20:28, 26 February 2012 (UTC) I'm trying to figure out whether US copyright law overrides law in other countries, specifically, if another country says a work published therein is public domain, is that overridden by this little gem, so that more restrictive US copyright renders the image non-free? Where is the best place to ask this question? (Navigating the copyright pages in Wikipedia is almost as hard as reading the copyright rules IRL!). Thanks! Franamax (talk) 21:25, 31 August 2008 (UTC)
